Competition for judge promoted by the Court of Justice of Tocantins. The event had already been suspended due to irregularities since November 12, 2004, by decision of judge Selene Maria de Almeida, of the Federal Regional Court of the 1st Region. The request to the CNJ was made by the Association of Judges for Democracy in a representation signed by its president, Marcelo Semer . The representation rapporteur, Eduardo Lorenzoni, voted for partial procedure and the other councilors followed Alexandre de Moraes' dissenting vote, canceling the competition and repeating it with the publication of a new notice.
On the day the request was considered, Marcelo Semer gave oral arguments on behalf of the entity. According to the AJD representation, the competition was being held without the participation of a representative from the OAB, which is mandatory according to the constitutional norm. The Dubai Email List competition also included a reserved “social investigation” phase, which made it possible to eliminate candidates based on subjective criteria. Furthermore, the competition had some of the questions from the first test brought forward in previous competitions. According to Marcelo Semer, “the repetition of questions violates the principle.
Equality as it favors candidates who may have participated in the other competition or who have access to questions from the previous competition, nowadays fully facilitated by internet consultations. Repetition of questions violates the rule of confidentiality of the test for all candidates, which is essential to ensure impersonality in the competition and equal opportunity for participants”. The lack of participation by the OAB of Tocantins, in the competition, according to Semer, was motivated by the failure to accept suggestions for changes to the notice and the refusal to reopen the registration deadlines.
